Though we make every reasonable effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on us.

Due to the nature of the Service and the nature of the medium of the Internet and telecommunications facilities, we cannot guarantee that information (which may include personal information) transmitted by the user to us or through the Service or to third parties, will not be intercepted by, or disclosed to, unauthorized parties (including but not limited to government agencies) during or after transmission.

Similarly, when we send a message to a third party at the request of the user or as part of the Service, we also cannot guarantee that the information contained in that message will not be intercepted by, or disclosed to, unauthorized parties during or after transmission.

To date Hayai Broadband Pvt Ltd or it's directors have not received any official requests or warrants for subscriber information from any court or government agency in:

  • India (NTRO, R&AW, IRB, JCB)
  • New Zealand (GCSB, DDIS, SIS)
  • United States (NSA, DIA, FBI, CIA)
  • Australia (DSD, DIO, ASIO, ASIS)
  • Canada (CSEC, CDI, CSIS)
  • United Kingdom (GCHQ, DIS, MI5, MI6)
  • European Union
  • Any other jurisdiction (to be amended here if required)

although this does not necessarily rule out unrelated co-operation. Hayai Broadband Pvt Ltd provides access to subscriber records and a monitoring centre with unrestricted access to it's network at it's NOC for the purpose of lawful interception to the relevant agency as per the ISP licensing agreement (sections 8 & 29). Please note that certain agencies may at times access certain information without Hayai's permission, although we endeavour to prevent this as much as humanly possible and pursue all legal avenues available if/when such access is detected.
